CocoCloud Drive – DMCA Copyright Policy

1. Introduction

CocoCloud Drive (“CocoCloud,” “we,” “our,” or “the Service”) respects the intellectual property rights of creators, copyright owners, and content producers. We expect all users of CocoCloud Drive to comply with applicable copyright laws.

This DMCA Policy outlines how copyright owners may request removal of infringing material under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512, and how users may submit counter-notifications if they believe material was removed in error.

CocoCloud Drive operates as a cloud hosting provider and qualifies for the DMCA Safe Harbor provisions when responding to copyright complaints in good faith.

3. Filing a DMCA Takedown Notice

If you believe material stored on CocoCloud Drive infringes your copyright, you may request its removal by submitting a written DMCA Takedown Notice.

To be valid, your notice must include:

  1. Identification of the copyrighted work claimed to be infringed, or a list of works if multiple items are involved.

  2. Identification of the infringing material to be removed, including URLs, file paths, or any necessary information to locate it.

  3. Your contact information:
    • Name
    • Mailing address
    • Telephone number
    • Email address

  4. A statement that you have a good-faith belief that the use of the material is not authorized by you, your agent, or the law.

  5. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.

  6. Your physical or electronic signature.

How CocoCloud Handles Takedown Notices

Upon receiving a valid notice:

  • The allegedly infringing content will be disabled or removed.

  • The user who uploaded the content may be notified (“Copyright Notice”).

  • The copyright owner’s request may be forwarded to the uploader.

CocoCloud may refuse incomplete or invalid notices.

4. Submitting a DMCA Counter-Notification

If your content was removed and you believe the takedown was mistaken or unauthorized, you may submit a DMCA Counter-Notification.

Your counter-notification must include:

  1. Identification of the material removed and its previous location.

  2. Your name, address, phone number, and email.

  3. A statement under penalty of perjury that you have a good-faith belief the material was removed due to error or misidentification.

  4. A statement consenting to the jurisdiction of the Federal District Court for your district (or where CocoCloud is located if outside the U.S.).

  5. A statement that you will accept service of process from the complaining party.

  6. Your physical or electronic signature.

How CocoCloud Processes Counter-Notifications

Once received:

  • We will forward the counter-notification to the original complainant.

  • If the complainant does not file a legal action within 10–14 business days, we may restore the removed material.

  • CocoCloud is not required to restore material, especially if it violates other policies.

5. Repeat Infringer Policy

To comply with the DMCA Safe Harbor provisions, CocoCloud Drive enforces a strict repeat infringer policy.

An account may be terminated if:

  • Multiple valid DMCA notices are received regarding the user, or

  • A single severe copyright violation occurs, or

  • There is evidence of intentional infringement.

CocoCloud reserves the right to disable or terminate accounts at its discretion.

6. Misrepresentations & Abuse of the DMCA Process

Submitting fraudulent or bad-faith DMCA notices or counter-notices violates federal law.

Under 17 U.S.C. §512(f), individuals who knowingly misrepresent claims may be liable for:

  • Damages

  • Attorney’s fees

  • Costs incurred by CocoCloud or its users

We may deny service or pursue legal remedies against abusive reporters.

7. Privacy, Legal Requests & User Information

CocoCloud Drive may disclose user information when:

  • Required by DMCA procedures

  • Required by subpoena, court order, or law enforcement request

  • Necessary to investigate severe violations

We will not notify users where legally prohibited.

8. Limitations

CocoCloud Drive cannot adjudicate copyright disputes.
We comply with DMCA processes and rely on:

  • The accuracy of notices

  • The good-faith statements of reporters

  • Legal procedures for resolving disputes

Users involved in disputes must resolve them between themselves or through the courts.
